Shelly Drury is an incompetent and unethical valuator whose fictitious valuation of my business was used by an equally incompetent arbitrator in Vancouver, WA to plunder and maim a business I spent 12 years of my time and money building. Shelly spent probably no more than 2-3 hours on the entire valuation, yet charged me nearly 10,000 USD. Absolutely shameful price-gouging. Most of the valuation document is filler text, copy-and-paste, or template text, as evidenced by its irrelevance to my business and the fact that she left in the names and information of a previous client. That qualifies as breach of privacy. Yes, let me repeat that: the valuation I was FORCED to pay 10,000 USD still had the name and business of a former client on it. Shelly was hired to perform due diligence in understanding my business yet she never called me to discuss my business, as she said she would do in her initial email to me on May 18, 2023. The high-level questionnaire she had me fill out was not sufficient to understand the nuances of my business. During the meeting on June 26, 2023, she falsely stated, under oath, that she had called me for an interview. Shelly was assigned to my case by the arbitrator not because of her experience valuating businesses with low transferability in a niche technical field such as mine, but simply because she had experience testifying in dissolutions. i.e., Shelly is a veteran in the Divorce Industrial Complex, and another veteran in the Divorce Industrial Complex (the arbitrator) liked that. The value assigned to my business was a joke. "Insane" was the word used by other CPAs and numerous industry experts to describe her valuation. That would have been obvious enough if she had actually interviewed me and understood the nature of my business and its short-term, low-transferability contracts. The mere fact that capitalization of earnings method has been accepted in other court cases is not a basis for her lazily shoving numbers through a formula and calling it a day. She had a professional duty to valuate my business with the intent of determining an actual market value, and she did not do that, by her own admission during questioning. Yes, let me repeat that: by her own admission during the hearing, her valuation did not correspond to an actual market value. Equally shocking is that this admission did not bother the arbitrator whatsoever. Now, thanks partly to Shelly's fantasy valuation and partly due to the arbitrator's apathy, I now have a draconian judgment sitting over my head that threatens to bankrupt me, which will affect not only my own children but dozens of contractors and their families.
